Department of Education Shields School Districts

The Longview School District received a helpful hand from the US Department of Education in a teacher sexual misconduct case.

The DOE ruled that Longview could claim a privacy right under FERPA (The Federal Education Rights and Privacy Act). The case revolves around the allegations that JV volleyball coach, Eric Talley, groped a female student and the local newspaper’s request for records of the incident.

The Open Records Project fought and lost a similar eight year court battle with the Dallas Independent School District over the identities of the 20% of DISD teachers who were so bad that their students actually regressed during the school year. FERPA was cited as a defense by the district.
